In this episode, Hyde and Holbrook discuss two cases decided by the North Carolina Court of Appeals on September 17, 2024. In State v. Evans, COA23-1160, the Court of Appeals addressed the defendant’s challenge to the State’s evidence of larceny by an employee, concluding there was sufficient evidence of an intent permanently to deprive the owner, despite the defendant’s reimbursement of the funds. In State v. Wilkins, COA23-839, the defendant was convicted of false pretenses and obstruction of justice based on his false report that he had completed in-service training; the Court of Appeals held there was insufficient evidence of false pretenses and that the indictments for obstruction of justice were fatally defective.
