In this episode, Hyde and Holbrook discuss three cases decided by the North Carolina Court of Appeals on December 31, 2024. In State v. Wilson, COA23-1031, the Court of Appeals awarded the defendant a new trial where the trial court instructed the jury on the theory of kidnapping that was not alleged in the indictment. In State v. Farook, COA23-1161, the Court of Appeals rejected the defendant’s speedy-trial challenge but remanded for additional findings on his Harbison claim. And in State v. Williams, COA24-50, the Court of Appeals concluded that the protections of the castle doctrine statute applied to the defendant though he was outside of his motor vehicle at the time he used deadly force.
