In this episode, Hyde and Holbrook discuss three cases about digital evidence decided by the North Carolina Court of Appeals on December 31, 2024, and January 15, 2025. In State v. Hicks, COA20-665-2, the Court of Appeals held the defendant was entitled to a new trial based on the erroneous admission of prejudicial text messages and photographs. In State v. Davenport, COA24-330, the Court of Appeals concluded that the trial court did not err by admitting Facebook messages sent to the victim by the defendant when those messages were authenticated by distinctive characteristics. And in State v. Lacure, the Court of Appeals found the trial court did not err in allowing a lay witness to testify to the defendant’s location at the time of the offense based on cell tower data.
