In this episode, Hyde and Holbrook discuss three cases decided by the North Carolina Court of Appeals on July 2, 2025. In State v. Gilbert, No. COA25-32 (N.C. Ct. App. July 2, 2025), the Court of Appeals held that it was improper for the prosecutor during closing argument to refer to the defendant’s right not to testify, but the error was harmless given the overwhelming evidence of the defendant’s guilt. In State v. Tadlock, No. COA24-459 (N.C. Ct. App. July 2, 2025), the Court of Appeals found sufficient evidence to support two separate convictions of assault by strangulation. And in State v. Wingate, COA24-815 (N.C. Ct. App. July 2, 2025), the Court of Appeals concluded the trial court prejudicially erred by allowing two expert witnesses to vouch for the victim’s credibility by testifying that their findings were consistent with the victim’s disclosure of sexual abuse.
